These Terms of Service ("Terms") govern your access to and use of the Motivational Monk website and app (together, the "Service"), provided by Aurelium Labs LLC ("Aurelium Labs," "we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility & accounts

You must be at least 13 years old (or the minimum age of digital consent in your region) to use the Service. You are responsible for your account credentials and for all activity under your account. Keep your password secure and notify us of any unauthorized use.

2. The nature of the Service — important

Motivational Monk is a motivation, productivity, and accountability tool. The "Monk" is an AI persona with a deliberately blunt, tough-love tone, designed to encourage you toward goals you set for yourself.

The Service is for general informational and motivational purposes only. It is not professional, medical, psychological, therapeutic, legal, or financial advice, and it is not a substitute for care from a qualified professional. The Monk's blunt messages are motivational, not clinical. If you are struggling with your mental health or experiencing a crisis, please contact a qualified professional or your local emergency services.

3. Your content

You retain ownership of the goals, tasks, logs, and messages you create ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, store, process, and display Your Content solely to operate and improve the Service for you — for example, to sync it across your devices and to generate the Monk's coaching responses.

4. Acceptable use

When using the Service, you agree not to:

Break the law or infringe anyone's intellectual property or privacy rights.
Upload malware or attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
Scrape, resell, or commercially exploit the Service without our written permission.
Use the Service to harass, harm, or deceive others.

5. Subscriptions & payments

Motivational Monk offers a free trial and paid plans ("Pro"). Current Pro pricing is $9.99/month or $69.99/year. Paid subscriptions purchased on our website are billed through our payment provider, Stripe; subscriptions purchased through a mobile app store are billed by that store. Subscriptions renew automatically at the then-current price unless cancelled before the end of the current billing period.

Free trial — your trial grants full access for the stated period. If you do not start a paid plan, access ends when the trial expires.
Cancellation — you can cancel anytime; you'll keep access through the end of the period you've paid for.
Refunds — except where required by law, payments are non-refundable.

6. AI features

The Monk's responses are generated by automated and AI systems and may contain errors, omissions, or content you disagree with. Always use your own judgment, and do not rely on the Service for decisions that require professional expertise.

7. Intellectual property

The Service, including its design, branding, the Monk character, and software (excluding Your Content), is owned by Aurelium Labs and protected by intellectual property laws. We grant you a personal, non-transferable, revocable license to use the Service in accordance with these Terms.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that could cause harm. Upon termination, the licenses you granted us end, except as needed to comply with legal obligations or complete pending operations such as billing.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that its content will be accurate or suitable for your circumstances.

10. Limitation of liability

To the maximum extent permitted by law, Aurelium Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

11. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. If we make material changes to the Terms, we will provide notice in the app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction in which Aurelium Labs LLC is established, without regard to conflict-of-law principles. Mandatory consumer-protection rights in your country still apply where required.
